MINUTES
October 9, 2007
Regular Session
Pursuant to notice and call the Waverly City Council met in regular session at 7:00 p.m. on Tuesday, October 9, 2007 in the council chambers of Waverly City Hall. Those in attendance were Mayor Ken Hausladen, Clerk Debbie Ryks, and Council Members: Ken Antil, Deb Hausladen, Pam Henry-Neaton, and Gary Olson.
Agenda
The agenda was amended with the addition of Open House Events and Winsted/Waverly Elementary Schools under New Business.
Motion by Ken Antil, seconded by Deb Hausladen to approve the agenda as amended. Carried 5-0.
Rob Beckfeld-September Building Inspection Report
Building Inspector Beckfeld reported that John LaPlant hopes to open the All American Grill and Brewhouse restaurant on October 22, 2007. Beckfeld has projected that the opening may be delayed until mid November pending completion of the state required items. Currently, LaPlant is waiting for the new hood for the kitchen and installation. He has received full approval from the Minnesota Department of Health. LaPlant will be installing a new cooler below the floor and the cooler entrance was changed to comply with state issues.
The Church of St. Mary parish center is ready for final inspections. Beckfeld completed a walk through with the job superintendent.
No new home construction permits have been issued. The homes under construction by CMC Home Builders are still on hold. Mayor Ken Hausladen asked that the Planning Commission review the Code of Ordinances regarding the six month time frame in which no work has been performed. Rob Beckfeld will check the building codes for applicable standards that apply. Rob Beckfeld will give the addresses of homes that are in non-compliance to Planning Commission Chairman Bob Winters for review by the Planning Commission.
Re-roof permits are being issued throughout the city. Due to storm damage, many home owners are in need of roof repairs. If a permit is not obtained and the work is performed the penalty is a double fee and a permit needs to be obtained. Residing permits are also necessary. Permit costs are $25.50. Permits expire in six months. One permit may be obtained for two buildings located on one lot such as a residential dwelling and detached garage.
Wanda Tussing-Municipal Liquor Store Report
Manager Wanda Tussing reported that the September Financial Report needs to be adjusted to reflect that $7,000 was received in a transfer from the savings account for the bond payment. The profit and loss report does not show the transfer in from the savings account. The profit should be shown as $3400 for the month of September. Tussing reported that the statewide smoking ban went into effect on October 1. Business has not been affected to a great extent.
Motion by Deb Hausladen, seconded by Pam Henry-Neaton to approve the September 2007 Municipal Liquor Store Report. Carried 5-0.
Ken Hausladen noted that banners were taken down from the car show event recently.
Park Commission Report-Ken Antil
The September 26, 2007 Park Commission Meeting minutes were reviewed. The bench and tree donation programs are being researched.
Maintenance Report
Maintenance Supervisor Rassat submitted a written report since he was unable to attend the meeting. It was noted that the report indicated that the Industrial Park utility work is almost complete.
Crosswalks throughout the city were painted by the City of Howard Lake. It was mentioned that the crosswalk markers located in other communities are desired on Highway 12 in Waverly. Clerk Ryks reported that City Engineer Barry Glienke was looking into the state permits required. An update on this project is needed from Barry Glienke.
Planning Commission Report-Bob Winters
Chairman Bob Winters reported that Variance application guidelines are being formulated by the Planning Commissioners.
The Waverly Rental Housing Ordinance draft should be completed to present to the council next month.
EDA Report-John Konrath
Economic Development Authority President John Konrath reported that the EDA met jointly with the council on September 25 regarding land refinancing options for the 2.7 acre parcel in the Waverly Industrial Park. The City agreed to pay down the principal from the Maintenance Building account and to enter into a lease purchase on the land. A 20 year term is preferred with annual payments estimated at $13,000. The annual budget for the maintenance building account will be used for bond payments. The EDA will be released from its obligation as to the original note. Shelly Eldridge, Ehlers & Associates is working on the lease purchase. There will be no prepayment penalty on the lease purchase arrangement.
Joe DesMarais-320 Pacific Avenue
Joe DesMarais, Lazy J Sales was present at the meeting to request a two year blacktop waiver for his parking lot at 320 Pacific Avenue. A large amount of fill was used on the lot and the south area is settling. Due to the condition of the parking lot, blacktop surfacing would not hold. DesMarais’ excavation contractor will be doing additional work in the future to accommodate a blacktop surface.
Jeff Vogt, J & T Motors stated that he had to haul in class 5 to restore soft areas for his parking lot.
The council discussed approving a waiver for the blacktop at 320 Pacific Avenue. It was decided that a June 30, 2008 blacktop compliance date would be required.
DesMarais stated that he experienced some problems with his building project but did not specify the issues.
Wright County Sheriff’s Department
Mayor Ken Hausladen asked that the Clerk contact the Wright County Sheriff’s Department and request that officers provide patrol for stop sign violations. Barking dogs are also becoming a source of complaints to the city. Clerk Ryks reported that a telephone call was received regarding the chickens at 5375 Dempsey Avenue. The council authorized the police to cite the occupants for the keeping of farm animals if they are still housing chickens.
Waverly Fire Department Inc.
Fire Chief Karels authorized the lifting of the burning ban from Oct 15-31, 2007 for the of burning leaves. The council members received invitations for the Annual Firemens Dinner at the Knights of Columbus Hall on October 20.
Minutes
The minutes of the September 5, 2007 Special Session were presented for approval.
Motion by Ken Antil, seconded by Gary Olson to approve the September 5, 2007 Special Session minutes as presented. Carried 5-0.
The minutes of the September 13, 2007 Regular Session were presented for approval.
Motion by Ken Antil, seconded by Deb Hausladen to approve the September 13, 2007 Regular Session minutes as presented. Carried 5-0.
The minutes of the September 25, 2007 Joint Meeting with the Economic Development Authority were presented for approval.

Accounts Payable
The accounts payable for the month of October 2007 was presented in the amount of $56,274.67.
Motion by Deb Hausladen, seconded by Ken Antil to approve the accounts payable in the amount of $56,274.67. Carried 5-0.
Welcome to Waverly Update
Deb Hausladen reported that she conducted 3 welcome visits this month.
City Newsletter
It was noted that the quarterly newsletter mailing was completed. There were 658 newsletters mailed by the office staff.
Administration
The council scheduled a public hearing to consider proposed assessments for unpaid utility bills. The hearing will be held during the November 13, 2007 council meeting at 7:15 p.m.
Motion by Olson, seconded by Antil to schedule the public hearing on November 13, 2007 at 7:15 p.m. Carried 5-0.
The council was informed of an invitation to the annual meeting and dessert buffet being held at the Wright County Historical Society on October 16.
Summary of Closed Meeting-September 13, 2007
Mayor Ken Hausladen read the summary of the September 13, 2007 Closed Session. A personnel meeting was conducted to discuss restructuring of the administration of the Parks Department.
Christmas Eve/New Years Eve
The council agreed to close the city offices and maintenance operations on Monday, December 24, 2007 and Monday, December 31, 2007. Employees will be required to use vacation leave on these dates. Clarification was made as to maintenance staff working in the case of a snow storm and that water and sewer rounds need to be conducted. This issue was brought up due to the fact that Christmas Eve and New Years Eve fall on Mondays and the Christmas and New Year’s holidays fall on Tuesdays this year. This will allow employees to take advantage of a long weekend with the holidays.
Fire Hydrant Maintenance
Mayor Ken Hausladen questioned whether the council was interested in pursuing a maintenance policy for fire hydrants similar to sidewalks. Fire hydrant maintenance by residents is not included in the Code of Ordinances. There was not any interest by the council members to pursue this issue. Clerk Ryks will post a message this winter regarding clearing snow away from fire hydrants.
New Business
Council Member Pam Henry-Neaton stated that storm sewers need to be cleaned due to a build up of leaves.
Ice Festival-January 26, 2008
The Montrose/Waverly Chamber will hold the annual Ice Festival event at Legion Park on January 26, 2008. This is an informational item and does not require approval by the council.
Open House Events-Winsted/Waverly Elementary Schools
Council Member Pam Henry-Neaton informed the council that open house events will take place at Winsted and Waverly Elementaries on October 25. There will be a ribbon cutting in Waverly at 7pm. The council members were encouraged to attend this event. Henry-Neaton also reported that relocation to the new High School will take place in February rather than in January as previously reported. The Christmas break was previously extended to accommodate the move. The school will be closed for a mid winter break on February 13-15 rather than extending the Christmas break.
Acknowledgements/Recognition/ Announcements
Council Member Pam Henry-Neaton announced that the Citizens State Bank “100” year anniversary celebration event is being held on Oct 14, 2007 at the new Parish Center.
The United Fund Drive is underway and the public is encouraged to consider making donations. Donations are being accepted through the end of October.
