July 17, 2002 The Waverly City Council met in special session at 7:30 p.m. on Wednesday, July 17, 2002 in the council chambers of Waverly City Hall. Those in attendance were Mayor Bush, Clerk Ryks, and Council Members Hausladen, Olson, and Henry-Neaton. Council Member Hertzog was absent. The purpose of the meeting was to conduct a public hearing regarding a proposed annexation and a special meeting to consider approval of the proposed annexation ordinance and to continue regular business from the July 9, 2002 council meeting. Public Hearing: Annexation, Tom Ryan Property Mayor Bush opened the public hearing at 7:30 p.m. Bush set a time limit of 30 minutes for public comments regarding the proposed annexation. Attorney Nate Bissonette presented a map showing the location of the property which is proposed for annexation. The property is located east of Carrigan Lake and contains 45 acres. 41 acres was previously annexed adjacent to this property. There is no development plan, buyer, or builder at this time. The annexation request is based upon future land development in the city. The proposed annexation procedure is regulated by Minnesota Statutes and is classfied as Annexation by Ordinance because the land is 60 acres or less. Daryl Lachermeier was present at the meeting and stated that the Lachermeiers have no objection to this annexation and may want to annex their property in the future. David and Nancy Remer had a letter brought in by their neighbors Gary and Brenda Bury. The letter was read aloud by Mayor Bush. It stated that the Remers would like the land to remain agricultural and not be developed. Brendy Bury was present at the meeting to provide comments on the proposed annexation of land. She owns property adjacent to the property proposed for annexation and wants the land to remain agricultural. Mayor Bush explained that the city wants to control growth. This area is growing and the city can control the development if it is annexed. If the property is not annexed into the city, the city has no say over the land development and it may be developed in the township. Gloria Janikula-Clerk of Woodland Township was present at the hearing and asked about the comprehensive plan of Montrose which includes a future annexation area to Crofoot Avenue, east of Waverly. Planning Commissioner Adrian Duske stated that this annexation would match up to Crofoot Avenue if Crofoot Avenue was ever extended on the south side of highway 12. Crofoot lies on the section line. Montrose has used Crofoot Avenue as a future western boundary. There are no city streets that provide access to this property. The developer would have to propose a plan to the council for the location of streets and the city would have the final decision making authority over the street locations. Adrian Duske would like to see a future access from highway 12 to this property when a development plan is brought forth to the city. Lachermeiers plan to annex and sell their property to a developer in the future. An access could go through their property. Bury would like the city to consider the survival of the township and farmers. Mayor Bush explained that growth is being experienced along the highway 12 corridor. Woodland Township has adopted an annexation compensation plan which determines an alternative for townships to be compensated for future loss of property taxes. Nate Bissonette explained that Minnesota Statutes determine the tax split arrangement for annexations by ordinance. Woodland Townships new compensation policy does not apply under this method of annexation. Compensation policies could be used with orderly annexation agreements where the township and city negotiate an arrangement. The MN Legislature has not changed the law to compensate townships for lost taxes. Gene Janikula, Woodland Township inquired as to the previous annexation and the previous owner of a narrow strip of land that was purchased by Ryan. This property was bought from the Douglas trust. Discussion continued regard the consideration of the city to keep the 5 acre piece of land east of the Crofoot Avenue line out of the annexation to remain in Woodland Township. Council Member Hausladen pointed out that Waverly did not determine this line as a future boundary between the cities of Waverly and Montrose. It was included in the City of Montroses comprehensive plan but Montrose did not check with Waverly regarding this boundary when they determined their future growth area. Motion by Bush, seconded by Hausladen to close the public hearing at 8pm. Carried 4-0. Motion by Hausladen, seconded by Henry-Neaton to adopt Resolution 2002-07 approving the proposed annexation ordinance. Carried 4-0. Minutes Motion by Hausladen, seconded by Olson to approve the minutes of the June 11, 2002 Regular Session as presented. Carried 4-0. Accounts Payable The claims related to the flood are noted in the description as Flood Relief. The claims list includes all invoices received through yesterday. Certificates of Indebtedness David DeLude David DeLude was present at the meeting to request that the council approve a payment plan for his delinquent utility bill. He has been on disability and is going back to work on August 6. He has proposed to pay $100 per week against his utility bill starting on July 26 and every Friday thereafter until the total utility bill is brought current. Motion by Hausladen, seconded by Bush to approve the proposed payment agreement. Carried 4-0. Clean up day Jim Thrift Maintenance employee Jim Woitalla asked about changing the electrical service for Jim Thrift to the alley. If the service was changed, the neighborhood would lose the street light. Woitalla will poll the neighbors for any objections to the deletion of the street light. Flood Situation There are currently 325 FEMA applications in Wright County. Council Member Hausladen asked about providing Volunteer Shirts for Firefighters. It was decided that thank you notes will be sent to firefighters. Ken Hausladen stated that City staff needs to take time off since they were overworked and experienced heavy stress during the flood emergency.
