Regular Session
Pursuant to notice and call the Waverly City Council met in regular session at 7:00 p.m. on Tuesday, April 13, 2010 in the council chambers of Waverly City Hall. Those in attendance were Mayor Ken Antil, Clerk Deb Ryks, and Council Members: Connie Holmes, Keith Harris, John Konrath, and Gary Olson. Maintenance Supervisor John Rassat, and Senior Maintenance Worker Jim Woitalla were also present at the meeting.
Agenda
The following items were added to the agenda under New Business: Comprehensive Highway 12 Plan update, Delano-Dassel Highway12 Corridor Group, MN Dot update, and health care reform meeting request.
Motion by Olson, seconded by Holmes to adopt the agenda as amended. Carried 5-0.
Wright Co Sheriff Monthly Report
There was no report given on behalf of the Wright County Sheriff’s Department.
Waverly Fire Dept
Maintenance employee Jim Woitalla asked for details on the water ball tournament scheduled during the May 1, 2010 Community Fair event. Keith Harris stated that other fire department members are involved with the planning of this event and should be contacted directly.
Bldg Inspection Report
Building permit activity has been very slow with two permits being issued in March.
Municipal Liquor Store Report
Manager Wanda Tussing reported that there was a profit of $7,928 in the month of March less the bond payment.
Council Member Connie Holmes asked for an accumulative report showing three months figures and the year comparison. This type of report would give an accurate accounting of profit and loss. The Municipal Liquor Store is making good progress.
Motion by Holmes, seconded by Konrath to approve the March 2010 financial report. Carried 5-0.
Public Requests
Melissa Morris representing the Montrose-Waverly Chamber of Commerce gave a report of the plans for the May 1, 2010 Community Craft Fair event. The event is replacing the community expo event and is being held in Railroad Park.
Portable bathrooms will be placed along the park property. There will be antique carriage rides. The carriage will stay off busy streets for safety reasons. A Chili Cook off competition will be held in the Waverly Village Hall starting at 8am. There will be readings and book signings by local authors. Art exhibits will be displayed in the Village Hall. Dr. Kirkpatrick will conduct a pet clinic from 10am-1pm. A pet parade will take place at 11am. A cherry pie eating contest will take place at 1pm. The Waverly Lions will have a beer garden. There will be various events with musicians playing throughout the day. Seating will be provided on hay bales. Vendors will participate in the event with Pete’s Grocery providing pork chops on a stick. The Knights of Columbus will have a food booth. Vendors will be bringing generators. There is 110 volt electricity for the stage with only 4 outlets accessible in the park. There are 15-20 amp breakers. The Village Hall dumpster may be used. The event will be relocated to the Humphrey Elementary School in the case of inclement weather. The What Next studio will be open for face painting, temporary tattoos. There are many events geared toward kids. The Wright County Sheriff Reserves will provide police protection for the event. Set up activities will take place on Friday night.
Ken Davis, a resident of Waverly stated that the City Newsletter is appreciated. Davis commented that snow removal service provided by city Maintenance staff is excellent. He inquired about the weed removal procedure in vacant lots. Maintenance Supervisor Rassat reported that mowing of vacant parcels may be done by Wright County and the costs will be assessed on the property taxes.
Parks
There has been no activity in the parks department. The Park Commission has not met recently as there is no new development activity.
Planning Commission
The March 18, 2010 minutes were reviewed.
Planning Commission Ex-Officio Ken Antil reported that the proposed Right of Way Ordinance was reviewed and recommended for approval by the council. A sample fee schedule for right of way permitting was received from the League of Minnesota cities and suggested for incorporation with the ordinance. There was a stipulation that the city will make the determination of fees as needed with amendment to the City fee schedule.
Ordinance 2010-1-Right of Way Ordinance was presented for approval.
Motion by Konrath, seconded by Holmes to adopt ordinance 2010-1 as presented. Carried 5-0.
Council Member Connie Holmes stated according to the minutes there was discussion on building project oversight. The city has adopted the State building code and is subject to enforcement based on the state regulations. John Konrath is checking with the City of Delano on their procedures for enforcement.
Economic Development Authority
The March 22, 2010 minutes were reviewed. Connie Holmes reported thatTodd Hagen, Ehlers presented information on business incentives. Material was distributed on incentives and grants to review at the April meeting.
Nicole Scheldrup is interested in EDA membership. She has a bachelor degree in communication. The Board is asking to seat her as a member pending meeting her at the April EDA meeting.
Motion by Holmes, seconded by Konrath to agree to the appointment of Nicole Scheldurp pending a meeting with EDA. Carried 5-0.
Maintenance Report
The Spring Clean up day event is set up. Mary Johnson and Pam Henry Neaton will be assisting with the collecting of fees at the clean up event. Council members will also participate in the clean up day event.
Maintenance Supervisor John Rassat presented quotations received on mowing equipment. Six mowers were evaluated. The mowers range in price from $7,689 to $11,955 with various options and warranties offered. The John Deere Diesel mower is preferred by maintenance employees. A $8,900 trade in is being offered on the current mower that was originally purchased for $9,400. The John Deere gas mower is the second choice. The John Deere dealership is nearby and convenient for purchasing parts. The Ex-mark gas mower is the third choice. The dealership is located in Waconia. The Maintenance employees recommend the purchase of the John Deere Diesel mower for a purchase price of $9,600 including tax.
Motion by Olson, seconded by Konrath to purchase the John Deere Diesel mower as recommended by maintenance staff. Carried 5-0.
Rassat reported that a 2003 Dodge Dakota Truck was purchased. The 1991 Ford One ton truck was sold to a private party.
John Rassat informed the council that this is his last council meeting before his retirement. He thanked the council for support given during his employment. Mayor Antil commended him for his years of service and efforts in improving maintenance operations on behalf of the city.
Senior Maintenance Worker Jim Woitalla informed the council that the Waverly Lions asked about conducting additional work in the Village Hall. They are proposing to install new ceiling tiles in the Village Hall basement. The cost of the ceiling tiles is $1,106. A 50/50 split with the Lions is proposed. Maintenance Supervisor Rassat informed the council that there has been a $3000 total city cost for the Village Hall project. The labor was donated by the Lions.
Motion by Holmes, seconded by Olson to approve the additional work as proposed by the Waverly Lions. Carried 5-0.
The park opening work will be done next week. City parks are being opened earlier this year due to the warm weather.
The Water Department will be flushing hydrants this week.
Lake spraying was ordered from the Lake Association. Connie Holmes will ask the Lake Association about changing companies for milfoil treatment.
The Waverly Community Homes lift station needs to be repaired due to leakage. Infratech provided the lowest of three prices of $2,985 for the lift station repair. Storm drains throughout the city are sinking and are in need of fixing. The repair cost is $3,000 for all locations.
Senior Maintenance Worker Jim Woitalla obtained quotations on street patchwork throughout the city. Three quotes were received. Knife River provided the lowest price. Asphalt repair at Legion Park is included due to the extension of a pipe. The total price of the asphalt patching is $18,000. $3,800 will be paid from the parks budget.
Woitalla presented sealcoating pricing. Pearson Brothers lowered their initial price. Pearson quoted $53,000, and Astech, quoted $47,000. There is more oil used by Pearson. Both quotations are at $.99/SY. Pearson performed the seal coat on North Shore Drive in 2009.
Motion by Konrath, seconded by Olson to authorize Woitalla to hire Pearson Brothers for the sealcoating work. Carried 5-0.
Pricing was received for Crack sealing work in various locations. Gopher State issued the lowest price. The cost estimate is $19,000 with a 3 year warranty.
The total cost of all three projects including street patching, sealcoating, and crack sealing is $84,000. The city will retain the granite chips from the seal coating.
Motion by Harris, seconded by Holmes to authorize the patchwork and crack sealing as recommended. Carried 5-0.
Minutes
The minutes of the March 9, 2010 Regular Session were presented for approval.
Motion by Harris, seconded by Olson to adopt the minutes of the March 9, 2010 Regular Session as presented. Carried 5-0.
Accounts Payable
The accounts payable was presented in the amount of $97,278.12.
Motion by Olson, seconded by Holmes to approve the accounts payable in the amount of $97,278.12. Carried 5-0. Items included in the monthly bills are two months of police protection, the final auditing bill, bond consulting fee for the 2010 tax anticipation certificate, and financial planning services provided by Ehlers.
Welcome Packets
There were no new resident welcome packets delivered this month.
Administration
Clerk Ryks asked the council whether there was interest in Rev track, for the option of receiving web based payments for city utilities, permits, license fees, etc.
The council asked for additional information prior to consideration on this item.
Old Business
Council Member John Konrath stated that after obtaining information and pricing on web site design services from several companies, he is recommending Paradigm Solutions, a local company. The company owners reside in Waverly. .The cost of the web design services will range from $2700-$4700 based upon the items the city is interested in using in the initial design of the new web site.
Motion by Konrath, seconded by Harris to accept the quotation for web design services by Paradigm Solutions for no more than the starting cost of $3,000. Carried 5-0.
Franchise agreements
Clerk Ryks forwarded information on existing franchise ordinances for electricity and natural gas to the City Attorney to review. The existing electric franchise agreement is not due to expire this year. The natural gas franchise will expire in July 2010. An existing agreement with Wright Hennepin electric expired in 2008.
MN Dot Repayment Agreement
In setting up a payment arrangement, the council is interested in sending representatives to a negotiation meeting with MN Dot. In a telephone conversation, Clerk Ryks was informed that MN Dot would like a letter stating the amount and timing of annual payments to begin in 2011. Council Members John Konrath and Connie Holmes are interested in representing the council in negotiations. Clerk Ryks will make contact with MN Dot and request a meeting for negotiations. State Senator Koch will be advised of the meeting date.
Healthcare Reform Mtg
Clerk Ryks reported that Glenn Roberts, a city resident is interested in holding a public meeting regarding the effect of health care reform on city residents. Specifically, he would like to address long term care issues. Roberts is in the insurance business and works with a gentleman that would be interested in making a short presentation to the council prior to a community meeting. The council was unsure if this meeting would be appropriate if it is pertinent to Roberts’ insurance business. It was decided that Mayor Ken Antil would contact Glenn Robert to obtain more information on his intention with the proposed meeting with the City Council.
Wright County Comp Plan Update
Wright County is updating the comprehensive plan with focus on the highway 12 corridor. A public meeting is scheduled for April 29, 2010. Connie Holmes will plan on attending the meeting.
Delano-Dassel Community Marketing Group
The City of Delano is heading a committee of highway 12 corridor cities in marketing the area of highway 12. A committee meeting will be held in Waverly on April 21 at 3pm.
Eagle Scout Ceremony
Jakob Thisius will be a recipient of an Eagle Scout award on April 18 , 2010 at 2pm in a court of honor ceremony. The City Council is invited to attend the ceremony. Thisius’ scout project included the Welcome sign.
City Engineer-Barry Glienke
City Engineer Barry Glienke reported that Ehlers is running additional figures to review with the utility rate study.
Glienke is waiting to hear from City Attorney Rhonda Pagel regarding a legal opinion on the collection of outstanding bills and completion of developments. Glienke believes that an assessment policy could be established to assess unpaid costs to the property taxes of unsold lots in the developments. Property foreclosure voids the development agreements. Glienke reported that Lakeland Development and Finance, the financial backer of many of the residential developments has no cash to back development agreements. The city would need to work within the confines of the 429 assessment procedure. There would be a public hearing regarding proposed assessments. This procedure would be guided by the City Attorney.
City Attorney Pagel composed a letter to be sent to the City of Montrose regarding a request for information on the financial operation and debt of the Montrose Wastewater Plant in which Waverly is a major user. The correspondence was reviewed by Council Member Holmes.
Clerk Ryks asked the council for verification on the preparation of April utility billings. The increase from Montrose is effective with the April billing for the period of March. The billings will split out Montrose plant charges. The $.75 increase in the plant base charge will not be charged to Waverly residents.
Acknowledgements/Recognition/Announcements
The council recognized city employee John Rassat for 17 years of employment with the City of Waverly. Rassat is retiring on April 30, 2010. The Waverly Lions were acknowledged for the Village Hall project.
